Terms of Use
1. About these Terms
These Terms govern access to and use of the public website medicalcannabis.systems. Use of the MCS platform by customer organisations, authorised professionals and associated users may also be governed by a commercial agreement, service terms, customer policies and system-specific rules. Where there is a conflict, the applicable contract governs the contracted service.
2. Service operator
MCS is operated by Nefos Solutions Ltd, an Ireland-based company. Contact: contato@medicalcannabis.systems.
3. Purpose of MCS
MCS provides technology supporting the operations of organisations working in the medical-cannabis context, including administrative functions and, where enabled, management of patients, professionals, documents, inventory, orders, dispensing and reporting. Features may vary by customer, country, configuration and version.
4. Not medical or legal advice
MCS is a technology platform. Institutional content, demonstrations and software functions do not replace diagnosis, prescribing, medical, pharmaceutical, legal or regulatory advice. Clinical decisions remain the responsibility of appropriately authorised professionals and organisations.
5. Authorised use
Platform users may access only accounts, records and functions for which they are authorised. Users must not improperly share credentials, bypass access controls, interfere with service security, introduce malicious code, access third-party information without authority, or use the service unlawfully.
6. Customer responsibilities
Each customer organisation is responsible for defining authorised users, maintaining appropriate information and permissions, meeting its legal and professional obligations, determining the purposes and legal grounds of processing for which it is responsible, and ensuring its use of MCS is compatible with rules applicable to its activities.
7. Accounts and security
Users are responsible for keeping credentials confidential and promptly reporting suspected unauthorised access to their organisation or support. We may take reasonable steps to protect the service, investigate misuse and restrict access where necessary for security, legal compliance or protection of users and systems.
8. Intellectual property
The MCS website, software, visual identity, documentation, interfaces and other materials are protected by intellectual-property rights belonging to Nefos Solutions Ltd or its licensors, as applicable. No ownership rights are transferred except for usage rights expressly granted under an applicable agreement.
9. Availability and changes
We aim to keep the service available and functional but do not guarantee uninterrupted or error-free operation. We may carry out maintenance, security updates, improvements and interface or feature changes. Material changes to contracted services will be handled under applicable agreements.
10. Third-party services
Some functions may depend on third-party infrastructure, services or integrations. Use of those components may also be subject to the relevant provider's terms and policies.
11. Privacy
Personal-data processing related to the public website is described in the MCS Privacy Policy. Data entered into the platform by a customer organisation may also be subject to the notices and policies of the responsible organisation and applicable contractual arrangements.
12. Liability context
To the maximum extent permitted by applicable law, liability connected with the service will be determined by the applicable agreements and law. Nothing in these Terms is intended to exclude or limit liability that cannot lawfully be excluded or limited.
13. Suspension and termination
Access may be suspended or terminated where provided by contract, requested by the responsible organisation, required for security or legal compliance, or in response to material misuse. Data handling following termination will follow applicable legal and contractual obligations and instructions.
14. Applicable contracts
These public Terms do not replace customer commercial agreements. Applicable law, jurisdiction, service levels, pricing, payment and contractual liability should be governed by the agreement entered into with each customer.
